TERMS AND CONDITIONS

1. Information on how to enter and win an Instant Prize form part of these Terms and Conditions. Participation in this ‘Pawlidays Scratch & Win Promotion’ ("Promotion") is deemed acceptance of these Terms and Conditions.
2. This Promotion is a game of chance for Instant Prizes which may be won by Eligible Entrants who make Eligible Entries in accordance with these Terms and Conditions (capitalised terms defined below).
3. The promoter is Petbarn Pty Limited (ABN 78 001 802 759) of Unit 6, 372 Eastern Valley Way, Chatswood NSW 2067, telephone: 02 9417 1744 ("Promoter” or “Petbarn”).
4. The Promotion commences at 12:00AM AEDST on Monday, 4 November 2019 and closes at 11:59PM AEDST on Tuesday, 24 December 2019 ("Promotional Period"). This Promotion will only be run in participating ‘Petbarn’ or ‘City Farmers’ stores in Australia that display advertising material featuring this Promotion (each a "Participating Store").

Definitions

5. For the purposes of these Terms and Conditions:
1. "HPP" stands for ‘Healthy Pets Plus’ and means a yearly membership to a complete standard of preventative healthcare services for dogs and cats of all ages and life stages that is provided by ‘Greencross Vets’. Please see here for relevant terms and conditions applicable to HPP;
2. “FFP” stands for ‘Frequent Feeder Program’ and is a feature of the ‘Friends For Life’ program where members who purchase any dog or cat food can redeem 15% off their next month’s food purchase. Members will continue to receive 15% off each month if they shopped at a Participating Store in the previous calendar month. Please see here for relevant terms and conditions to applicable FFP.
3. "Instant Prize"means a Major Prize or a Minor Prize;
4. "Major Prize" means each of the following:
1. one (1) $10,000 Cash Prize; and
2. one (1) Apple iPad 32GB Wi-Fi 6^th Gen (space grey) valued at $469;
5. "Minor Prize" means each of the following:

6.  “Winner” means a winner of an Instant Prize; and
7. “$” is a reference to Australian dollars.

Eligibility and entries

6. Entry is only open to Australianresidents aged 18 years and over. Individuals must be an existing member of the Promoter’s ‘Friends For Life’ program, or become a member of the Promoter’s ‘Friends For Life’ program by signing-up in a Participating Store with one of our team members or online at https://www.friends-for-life.com.au/customer/account/create, in order to be eligible to participate in this Promotion. When signing up for the ‘Friends for Life’ program, an individual must provide their first name, last name, telephone number and address, as well as any other information reasonably requested by the Promoter.
7. Employees (and their immediate families) of the Promoterand agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1^st cousin.
8. To be eligible to enter and receive a Scratch Card (defined below), Eligible Entrants must complete the following steps during the Promotional Period:

1. visit a Participating Store in person; or
2. visit www.petbarn.com.au (“Online Store”), and

spend $29 or more on any dog or cat products or services in a single transaction at that store (“Qualifying Transaction”) and retain their receipt or tax invoice in respect of their Qualifying Transaction.

If making a Qualifying Transaction at:

3. a Participating Store in person, request from a member of staff at that Participating Store at the time of making the Qualifying Transaction a scratch card relevant to the Promotion; or
4. an Online Store, receive a scratch card by delivery to the address provided by the individual during the Qualifying Transaction or if purchased via ‘Click & Collect’ order, request from a member of staff at a Participating Store at the time of collection of the relevant item the subject of the ‘Click & Collect’ order a scratch card relevant to the Promotion,

(each, a “Scratch Card”);  

1. scratch their Scratch Card to reveal whether or not they have won an Instant Prize and, if they have won an Instant Prize, make a claim in accordance with clauses 14 and 15 below; and
2. follow any other reasonable directions of the Promoter,

(each eligible entry, an “Eligible Entry”, and each eligible entrant, an “Eligible Entrant”).

9. Only one (1) Scratch Card is available per Qualifying Transaction (regardless of the amount spent in excess of $29 in that transaction). Multiple Eligible Entries are permitted subject to these Terms and Conditions.
10. If the Qualifying Transaction has been completed through an Online Store via ‘Click & Collect’, it is the Eligible Entrant’s responsibility to request a Scratch Card at the point of collection, as detailed in clause 8 a iv.  

Claims

11. Eligible Entrants must retain their original purchase receipt(s) and Scratch Cards as proof of purchase. Failure to produce the proof of purchase for a Qualifying Transaction when requested may, in the absolute discretion of the Promoter, result in invalidation of the relevant claim.
12. The Promoter reserves the right, at any time, to verify the validity of Eligible Entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of thePromotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
13. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
14. All claims for Major Prizes must be redeemed by completing the following steps:
15. contact customer service on 1300 655 896;
16. provide customer service with the requested details for redemption including full name, address, phone number, Friends For Life membership details and Scratch Card details; and then
17. send the Scratch Card, original purchase receipt of the Qualifying Transaction and note with the Winner’s full name, phone number, address and Friends For Life membership details to the following address:

15. Cash prize will be awarded in the form of a cheque.
16. All claims for Minor Prizes must be redeemed by presenting the winning Scratch Card to a member of staff at the Participating Store where the Qualifying Transaction was made, or if the Qualifying Transaction was made through an Online Store, bringing the winning Scratch Card in to a Participating Store and present the winning Scratch Card to a member of staff.
17. All Major Prize winners will have their name published online at www.petbarn.com.aufrom 6 January 2020.In the event of any Winners from South Australia of a prize valued over $250, their name will also be published in The Advertiser from13 January 2020.
18. The Promoter’s decision is final and no correspondence will be entered into.
19. Subject to the unclaimed prize draw clause, if for any reason a winner does not redeem a claim for an Instant Prize (or an element of the Instant Prize) by 11:59PM AEDST on Tuesday, 24 March 2020, then the Instant Prize (or that element of the Instant Prize) will be forfeited.
20. If any Instant Prize (or part of any Instant Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Instant Prize (or that part of the Instant Prize) with a prize of equal value and/or specification, subject to any written directions from a regulatory authority.
21. Any ancillary costs associated with redeeming any voucher are not included. Any unused balance of any voucher will not be awarded as cash. Redemption of a voucher is subject to any terms and conditions of the issuer including those specified on the voucher.
22. Total prize pool value is up to $3,125,387.50. The total prize pool includes the following quantities of each Instant Prize:

23. Instant Prizes, or any unused portion of an Instant Prize, are not transferable or exchangeable and cannot be taken as cash.
24. The vouchers for 20% off dog or cat food products cannot be used in conjunction with HPP or FFP membership purchases or any other offer unless specified otherwise.

Second Chance Draw

25. A draw will take place in the event of any unclaimed or forfeited Major Prize ("Second Chance Draw"), subject to the directions of any regulatory authority. Entries for the Second Chance Draw must be received by 11:59PM AEDST on Tuesday, 24 March 2020. Eligible Entrants can enter the Second Chance Draw by contacting customer services on 1300 655 896 during business hours and providing their contact details. These Terms and Conditions apply to a winner of the Second Chance Draw as if they were a Winner.
26. The Second Chance Draw may take place at Anisimoff Legal, Suite 5, Erina Plaza 210 Central Coast Highway, Erina NSW 2250 on Thursday, 26 March 2020 at 12:00PM AEDST. Winners, if any, will be notified in writing within two (2) business days of the draw and their names will be published online at www.petbarn.com.au from 30 March 2020. In the event of any Winners from South Australia of prizes valued at over $250, their names will be published in The Advertiser from 31 March 2020.

General

27. Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
28. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention, or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
29. Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all claims in excess of the advertised prize pool will be honoured. Any unclaimed or forfeited Instant Prizes that are part of the advertised total prize pool will be awarded in the Second Chance Draw. Scratch Cards are deemed void if stolen, forged, mutilated or tampered with in any way. There will be a total of 1,207,250 instant win scratch cards printed for this Promotion.
30. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 (Cth) or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion.
31. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Eligible Entry or claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Instant Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use of an Instant Prize.
32. The Promoter collects personal information ("PI") in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be viewed at https://www.petbarn.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s privacy policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant. The privacy policy also contains information about how Eligible Entrants may opt out, access, update or correct their PI, how Eligible Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
