1. Information on how to enter this customer survey competition (“Promotion”) and prize details form part of these conditions. Entry into this Promotion is deemed acceptance of these terms and conditions of entry.
  2. The Promoter is Petbarn Pty Limited (ABN 78 001 802 759) of U6, 372 Eastern Valley Way, Chatswood, Sydney NSW 2067.
  3. The Promotion Period is 12:00am AEDT 05/06/2020 to 11:59pm AEDT 24/06/2020 (“Promotion Period”).
  4. Entry is open to Australian residents, aged 18 years and over, who are Friends For Life members and who receive and complete a customer satisfaction survey from the Promoter, and submit an answer to the competition question during the Promotion Period.
  5. Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  6. Only one (1) entry is permitted per person.
  7. The Promoter reserves the right at any time to, in its sole discretion, verify the validity of entries and the entrant (including the entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that does not comply with these terms and conditions.
  8. At the commencement of the Promotional Period, the Promoter will send out a survey link to Friends For Life members asking for feedback in return for a $25 Petbarn/City Farmers gift card.
  9. To qualify as a valid entry, individuals must complete the feedback survey and enter a valid email address.
  10. Entrants acknowledge and consent to the entrant’s personal information being used by the Promoter and agencies and companies associated with the Promotion for the purpose of conducting this Promotion, distributing the prizes, marketing activities related to the Promoter, and for the purposes specified in the Promoter’s privacy policy.   The Promoter’s privacy policy is available on the Promoter’s website: https://www.petbarn.com.au/privacy-policy.
  11. Each participant with a valid entry receives:
    • 1 x $25 Petbarn/City Farmers gift card
  12. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value.
  13. Any ancillary costs associated with redeeming the gift card are not included. Any unused balance will not be awarded in cash. Redemption of the gift card is subject to any terms and conditions of the issuer including those specified on the card. Prize winners will be responsible for any tax liability associated with a prize.
  14. The prize is a gift for completion of the survey; chance plays no part in determining the winner(s).
  15. The prize winners will be notified before 19/07/2020 by email and/or phone (if available).
  16. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
  17. The Promoter and associated agencies and companies of the Promotion will not be liable for any damage to or delay in transit of the prize.
  18. An entry must not:
    1. infringe the intellectual property or other rights of a third party;
    2. be incomplete or illegible;
    3. be unlawful, defamatory, abusive, insulting, threatening, obscene, inflammatory, offensive or otherwise contain content which, in the Promoter’s opinion, is inappropriate or objectionable.
  19. If due to any reason whatsoever the Promoter becomes aware that a winner has not complied with any of the Promotion’s terms and conditions, that winner will have no entitlement to the prize, and will be required, at the direction of the Promoter, to return, refund or otherwise make restitution of the prize.
  20. Entrants warrant that the intellectual property rights in their entry are the property of the entrant. By submitting an entry to the Promotion, entrants agree to assign all rights in their entry to the Promoter and consent to the Promoter using the entry in any manner the Promoter wishes (including modifying, adapting or publishing the entry, whether in original or modified form, in whole or in part or not at all), by way of all media without the payment of any further fee or compensation. By submitting an entry, entrants consent to any dealings with the entry that may otherwise infringe their moral rights in the entry. The Promoter may copy any content submitted as part of an entry, cause the content to be seen and/or heard in public, and communicate the content to the public. The Promoter may also allow third parties to do these things. Entrants agree to sign any further documentation required by the Promoter to give effect to this arrangement.
  21. The Promoter accepts no responsibility for any problems or technical malfunction of any communication network or for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) any costs incurred.
  22. The Promoter (including its directors, employees, and its related bodies) and the agencies and companies associated with this Promotion will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  23. The Promoter reserves the right to change these terms and conditions at any time. If any changes are made, the Promoter will notify the public via its website.
  24. The survey is being conducted by independent market and social research firm Fiftyfive5. They are members of the Association of Market and Social Research Organisations and are therefore legally bound to ensure participants’ privacy. Click here to view their privacy policy
