    The Promoter

  1. The promoter is Petbarn Pty Limited ACN 001 802 759 of Quarter One, Level 2, 1 Epping Road, North Ryde NSW 2113, Australia (“Promoter”).

    2. Terms and Conditions of Entry

  2. Information on how to enter and the prize(s) form part of these terms and conditions.
  3. Participation in this promotion is deemed acceptance of these Terms and Conditions.

    4. How to Enter and Eligibility

  4. The Promotion is open to Australian residents who are aged 18 years or over who are Petbarn ‘Friends for Life’ members (“Participant”).
  5. To be eligible to enter, individuals must satisfy one (1) of the minimum spend requirements as below at a Participating Store during the Promotional Period (“Qualifying Transaction”):
    • **DOG OWNERS**: individuals must spend $20 or more in a single transaction on any Whimzees, Greenies, ProBalance or Bell & Bones Dog Treats. Any cat products purchased in the same transaction will not form part of the $20 minimum spend requirement; OR
    • **CAT OWNERS**: individuals must spend $20 or more in a single transaction on any Greenies Cat or ProBalance Treats. Any dog products purchased in the same transaction will not form part of the $20 minimum spend requirement.
  6. To receive an automatic entry, individuals must provide their Petbarn Friends for Life membership details to staff or input it online at the time of making their Qualifying Transaction. If a person makes their Qualifying Transaction online and they do not have a Friends for Life membership already, they must first opt to create one to receive an automatic entry into the promotion.
  7. Only one (1) entry into the promotion is permitted per person.
  8. For clarity, entrants will only receive an entry into one (1) draw depending on whether their Qualifying Transaction was made on Dog or Cat Eligible Products. If an entrant satisfies the minimum spend requirements for both Cat and Dog Eligible Products in the Qualifying Transaction, they will only receive one (1) entry into one (1) draw (not both draws), which will be determined by the Eligible Product/s that they spent the most on in the Qualifying Transaction (i.e. if the entrant spends $30 on Dog Eligible Products and $25 on Cat Eligible Products, the entrant will only be entered into the Dog Draw).
  9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  10. Incomplete or indecipherable entries will be deemed invalid.
  11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

    12. Promotion

  12. The Promotion commences on 13/08/2024 and closes at 11:59PM AEST on 02/09/2024 (“Promotional Period”). Entries must be received by the Promoter during the Promotional Period and by the Closing Time and Date.
  13. Entries will be divided into two (2) groups depending on whether their Qualifying Transaction was made on Dog or Cat Eligible Products for a total of two (2) draws. The draws will take place at 3 Amy Close, Wyong NSW 2259 on 03/09/2024 at 11:00am AEST, in the presence of an independent scrutineer. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified by phone and email within two (2) business days of the draw. Winners’ first initials, surnames and postcodes will be published in https://www.petbarn.com.au/petspot/competitions/dental-terms-conditions/ on 05/09/2024.
  14. The Promoter’s decision is final and no correspondence will be entered into.
  15. If a Prize is unclaimed because a Prize-winner cannot be contacted within twenty-two (22) business days following the Draw Date or if the Promoter determines that a Prize-winner is not eligible to participate in the Promotion, the Prize may, at the Promoter’s sole discretion, be forfeited and redrawn. The Promoter is not responsible if the Prize-winner cannot be contacted within twenty-two (22) business days after the Draw Date.
  16. A draw for any unclaimed Prizes may take place on 08/10/2024 at the same time and place as the original draw, subject to any directions from a regulatory authority. The Prize-winners, if any, will be notified by telephone and email within two (2) business days of the draw and their names will be published online at https://www.petbarn.com.au/petspot/competitions/dental-terms-conditions/ on 10/10/2024.
  17. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or suspend, substitute or modify a Prize, subject to any written directions from a relevant regulatory authority.
  18. Prize-winners consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

    19. Prize

  19. There are ten (10) Prizes to be won.
  20. Each Prize-winner will win a year’s worth of dental supplies for their pet depending on whether the pet is a dog or cat (and its size, in the case of dogs).
  21. There are five (5) Cat Packs valued up to $1,107.73 available for the group of entries that made their Qualifying Transaction on Cat Eligible Products. There are five (5) Dog Packs valued up to $3,701.53 available for the group of entries that made their Qualifying Transaction on Dog Eligible Products.
  22. Total Prize pool value is up to $24,046.30.
  23. Prizes, or any unused portion of a Prize, cannot be exchanged, negotiated, transferred or redeemed for cash, unless otherwise specified. If a Prize (or any part of a Prize) is unavailable for any reason, the Promoter in its sole discretion reserves the right to substitute the Prize (or part of the Prize) with a prize of equal value and/or specification.
  24. The Promoter’s decision on all matters will be final and no correspondence will be entered into.
  25. Any ancillary costs associated with redeeming a Prize are not included. Any unused balance of a Prize will not be awarded as cash. Redemption of a Prize is subject to any terms and conditions of the issuer including those specified on the Prize itself.

    27. Data Protection

  27. By entering into the Promotion, the Prize-winner(s) acknowledges that the Promoter may be required to (or may wish to) make a public announcement by print or electronic media, which may include their Personal Information.
  28. The information submitted to the Promoter, and its subcontractors or agents, for the Promotion contains data that allows the Participant to be identified, including name, address, and phone number (“Personal Information”). If a Participant declines to provide their Personal Information, they will not be eligible to participate in the Promotion or receive the Prize.
  29. The Promoter, its subcontractors, and agents, will process the Personal Information to administer the Promotion and to notify a Participant if they are a Prize-winner. The Promoter may also use the Personal Information of Prize-winners in social media posts or other media forms from the Promoter. The Promoter will only pass the Personal Information to agents of the Promoter (including outside of Australia) in accordance with the Promoter’s Privacy Notice which is available at: www.privacy.elanco.com.
  30. By participating in the Promotion and providing the Promoter with Personal Information, a Participant consents to the use of the Personal Information and being notified if they are one of the Prize-winners.

    31. Limitation of liability

  31. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
  32. Except for any liability that cannot be excluded by law (including Non-Excludable Guarantees), the Promoter (including its officers, employees and agents) excludes all liability for any cost, expense, loss, damage or personal injury whatsoever (including but not limited to loss of opportunity and loss of profits) whether direct, indirect, special or consequential (“Loss”), arising in any way out of the Promotion, including, but not limited to, where such liability may arise out of the following:
    • any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
    • any theft, unauthorized access or third party interference;
    • any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    • any variation in Prize value to that stated in the Terms and Conditions;
    • any tax liability incurred by a Prize-winner or Participant; or
    • use of the Prize by a Prize-winner and any accompanying person or any other person.

    33. General

  33. These Terms and Conditions are governed by the laws of New South Wales, Australia and any dispute arising out of or in connection with them will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
